put the Eighth Amendment does shape certian procedural aspects regarding when a jury may use the death penalty and how it must be carried out. Because of the fourteen Amendments Due
process clause, the Eighth Amendment applies against the state, as well as the Federal government. The U.S suprem court has determined that a penalty must be proportional to the crime, otherwise, the punishment. violates the Eighth Amendment's prohibition against cruel and unusual punishment. In performing it's proportionality analysis, the supreme court loks to the following three factors a consideration of the offenses gravity and the stringency of the penalty, a consideration of how the jurisdiction punishes it's other criminals, and a consideration
of how other jurisdictions punish the sam crime.
Racial bias has always been a significant issue in death penalty debates. There have been many careful statistical studies indicating that race play significant role in determining who lives.
For example, a study released in 2003 by the University of Maryland concluded that race,along with geography, is an important factor in death penalty decisions in that state prosecutors are more likely to seek the death penalty when the race of the victim is African- American.
Almost 80% of death row defendants have been executed for killing white victims, even thought in society as a whole African-American account for about half of number victims.
I am for the death penalty, because these penalty will be less crimes in the society and protect people of criminal and realization the justice in the society. I feel these punishment will finish murder in the society and will assistant people to lives life happy and safety.
